2007-08-13 | Boyd, Paul | British Columbia (Vancouver) | Paul Boyd was shot and killed by Vancouver Police Service officer Lee Chipperfield. Police officers arrived after a 911 call reported a two-on-one assault in progress near 16th and Granville in Vancouver. The first two police officers to arrive were in plain clothes and reported that there was no assault in progress and that the scene was peaceful. Boyd was kneeling on a small backpack while conversing with a man sitting on a bus stop bench. When the officers approached Boyd, one of them noticed that he was holding a hammer in his hand, drew his weapon and shouted for him to drop the hammer, which Boyd did. The officers did not identify themselves as police but nevertheless attempted to handcuff Boyd after forcing him to lie on the street. At this point Boyd got up from the ground and struck one of the officers in the temple allegedly with a chain of some kind. The police allege that this was a bicycle chain with a lock attached to it but this was disputed by sworn testimony of a civilian witness and forensic DNA testing found none of Boyd's DNA on the alleged weapon. According to a report released in 2009 by the Criminal Justice Branch, Boyd was shot 8 times with the fatal shot being fired while he was on his hands and knees and unarmed. All the shots were fired by the same officer, Constable Lee Chipperfield, a uniformed officer who had arrived on the scene with his partner shortly after the first pair of officers. However the CJB did not press charges against Constable Chipperfield. The witness evidence that Boyd was shot while crawling on his hands and knees and unarmed was confirmed in a video taken by a tourist which surfaced in 2012. The case was reopened and investigated by ASIRT, the Alberta Serious Incident Response Team with their report going to a Special Prosector in 2013. Once again the special prosecutor did not press charges against Constable Chipperfield on the grounds that a defence of self-defence would likely succeed since Chipperfield claimed to believe that Boyd was armed at the time he was shot. |
