Acquittal

On 17 March 2011, Moonis Elahi voluntarily surrendered himself to face a politically motivated case leveled against him. After 9 months protracted case proceedings, Justice ultimately prevailed when after hearing all parties and taking into account all facts brought before the court, Moonis Elahi was cleared of the accusations framed against him, by the honorable District & Sessions Judge, Lahore / Judge Special Court, Mr. Mujahid Mustaqeem Ahmad on 21 October 2011. The learned court in its order stated “…During cross examination of (PW.2 Basharat M. Shahzad, Deputy Director FIA/CBC, Lahore cum Investigating Officer) he conceded that during investigation of case FIR No.24 of 2010, no material establishing any nexus of Moonis Elahi accused (with that case) came to his knowledge”.[3] (Para 23. Moonis Elahi Vs The State, Case FIR No.05. Dated 27.01.2011. Application on Behalf of Moonis Elahi Under Section 249-A Cr.P.C in the Court of District & Sessions Judge, Lahore / Judge Special Court (Offences in Banks) Punjab, Lahore).

The learned court in its acquittal order stated “The golden principles laid down in celebrated precedents, referred supra, and the dictates of justice demand that the accused be acquitted / set at liberty and be saved from protracted”.[4] (Para 27.

Despite a clear court decision proving Moonis Elahi’s innocence, the accounts of his family owned companies remained frozen in a separate case till 2015. Finally, the Accountability Court Judge, Mr. Mahboob Qadir Shah in his decision dated 27 February 2015 defroze the accounts of the said companies stating "That accused Moonis Elahi and his family members have been dragged as political victimization. It is anomalous that none of the directors / share-holders / officers or agents of the both companies were initially nominated but at a belated stage Moonis Elahi was all of a sudden implicated in the reference."
