Uttar Pradesh Lokayukta

Uttar Pradesh Lokayukta or Up-lokayukta (Sanskrit: उत्तर प्रदेश लोकायुक्त and उपलोकायुक्त) is an anti-corruption ombudsman in Uttar Pradesh established under the Lokayukta Act, 1975.[1][2] The Lokayukta is from a non-political background and functions as a statutory authority probing into cases primarily related to corruption, government mismanagement, or abuse of power by public servants or ministers.[3] Though the Lokayukta lacks wide investigatory powers,[3] it has caught public attention by investigating high profile cases.[4][5]

On January 28, 2016, the Supreme Court of India, recalled its previous order and appointed a new Lokayukta after the state government failed to suggest one.[6]

Selection procedure

According to the Uttar Pradesh Lokayukta and Up-Lokayukta Act-1975, the Governor can appoint a person to be a lokayukta and one or more persons as up-lokayukta(s). This is after consultation with the Chief Justice of the Allahabad High Court, and the leader of the opposition in the state assembly whereas the Up-lokayukta(s) can be appointed after consulting the lokayukta.[10]

A person is eligible for the post of the Lokayukta or Uplokayukta if he/she fulfills the following criteria.[11]

Any person appointed as the Lokayukta or up-lokayukta serves the office for a period of six years[12] which was later appended to eight years,[13] as per U.P. Act no. 7 of 1981 with the perks, allowances and conditions of the Lokayukta same as that of the chief justice of the high court and that of an up-lokayukta to judge of a high court.[14]

Roles and Responsibilities

The functioning of the Uttar Pradesh Lokayukta are described as "The object of Lokayukta organization is to initiate inquiries on complaints regarding maladministration and corruption concerning State Public Servant".[3] The Lokayukta can investigate any inquiry with specific approval of the concerned ministry[15] and can handle only two types of complaints, Grievance and Allegation. Grievance means any claim by a person who faced injustice or undue hardship due to maladministration while allegation covers in relation to a public servant, any government company or corporation in the state or pension, and other claims.[3]

Lokayukta or an up-lokayukta has enjoyed the same powers as that of a civil court under the code of Civil Procedure, 1908 which includes summoning the person, checking any public record or request copy from any court or office, and issuing commissions for the examination of witnesses or documents.[16] The lokayukta is also required to make sure the safe custody of documents relevant, with every investigation conducted in private, and the identity of the complainant and of the public servant in the investigation should not be disclosed in any form unless it is not related to public importance.[17] After completion of investigation, the lokayukta is required to submit the report to the governor.[18]

In the case of a false complaint filed, the lokayukta is empowered to take appropriate action which may extend to three years imprisonment with fine, and the complainant can also be detained, under Code of Criminal Procedure, 1973. However, the person may appeal to the High Court which can be taken only by the session court.[19] However, in such case, the court is not entitled to compel the lokayukta or an up-lokayukta or any public servant to give evidence recorded or collected.[20]

The State Government by notification published in the gazette can confer additional powers for specific investigations in relation to the eradication of corruption[21] and can even allow lokayukta to make new rules for the same.[22]

Recommendations

Many names were suggested for selecting a new Lokayukta after term of existing one headed by N.K. Mehrotra expires, even allegedly including at least thirty dead judges in the list.[23] Despite objections by the chief justice of the Allahabad High Court and the governor, the state government send the name of retired judge Ravindra Singh at least four times to the governor despite being asked repeatedly to follow the procedures. The chief justice had raised strong objections citing Ravindra Singh's alleged political affiliations with the ruling government of the samajwadi party. The government also named an accused in the list.[24] The government headed by Akhilesh Yadav neither proposed a fresh name nor did it call a meeting of the selection committee consisting of the chief minister, leader of opposition in the state assembly and the chief justice of high court,[25][26] thereby governor Ram Naik rejecting the name of Singh fifth time on 25 August 2015.[27][28]However, the state government passed an amendment in the state assembly on 28 August removing the clause that required the chief justice of the Allahabad High Court to be a part of the selection committee now comprising chief minister (chairperson), the assembly speaker, the leader of the opposition, and a retired judge of the supreme court or high court;[28] thereafter; the bill is pending with the governor[27] who said that the bill would be approved only after consulting constitutional experts[29] who supported governor's stand for the same.[note 1]

Hearings in the Supreme Court

Multiples hearings occurred in the Supreme Court for appointment a new lokayukta. On 2 July 2015, the Supreme court sought the response of Uttar Pradesh government on a plea seeking replacement of state's current lokayukta N.K. Mehrotra,[31] with the Allahabad High Court asking the same from the government on 23 July 2015.[26] The apex court even issued a notice to the government on 4 December asking on initiating contempt proceedings against it for non-compliance of its previous order.[32] On receiving no reply from the government, the supreme court, on 14 December 2015, criticized the Uttar Pradesh government for not appointing a new lokayukta in the state which kept seeking more time,[27] while fixing the petitions on the issue for hearing on 16 December. The court had earlier upheld constitutional validity of extending tenure of lokayukta to eight years on 24 April 2014 and had asked for the list of possible appointees within six months.[9][13]

Since the state government failed to recommend before the deadline[33] the supreme court while exercising its constitutional power under Article 142 of the Constitution[34] appointed Virendra Singh as the new lokayukta [35][36] but later recalled its own decision after hearing a plea[37] and appointed former judge of Allahabad High Court Sanjay Mishra as a new lokayukta.[38] The state government was accused of concealing the facts and played a fraud upon the apex court.[39]

Appointment

The former Lokayukta N.K. Mehrotra was appointed on 16 March 2006 under the Uttar Pradesh Lokayukta Act.[12][13][40] After his term expired on 15 March 2012, the Uttar Pradesh government on the same day brought an ordinance and another on 18 March and extended the period from existing six to eight years, which was later upheld by the supreme court.[9][27]

On 31 July 2012, the state government cabinet approved to keep the office of lokayukta out of purview of RTI Act, 2005 citing secrecy while investigating corruption charges.[41][42] N.K. Mehrotra had completed nine years in office, the longest term ever by any lokayukta in the country.[43] On 16 December 2015, the supreme court invoking its constitutional powers appointed justice Virendra Singh as the new lokayukta who is the former judge of the Allahabad High Court, while expressing deep regret for constitutional authorities failing to comply on court's order.[44] The state government however respecting court's decision refused to fault itself following it.[45]

Following objection of Virendra's appointment,[46] later on 28 January 2016, the Supreme Court recalled its own decision and appointed former judge Sanjay Mishra as a new lokayukta after hearing a petition.[47][48]

Limitations of Powers

The lokayukta cannot act on any complaint pertaining to people occupying following constitutional posts.[3][55]

If the investigation involves internal security of the state or the disclosure of proceedings of the cabinet of the state government or any committee of that cabinet, then the person cannot be compelled to give any evidence or produce any document.[16] The state government after consultation with the lokayukta, in view of public interest, may exclude by notification in the gazette allegation against any public class servant, thus exempting him from investigation.[56]

The lokayukta gave clean chit to Noida engineer Yadav Singh[57] for allegedly amassing huge wealth in spite of being investigated by the CBI.[58]

The following matters cannot be covered in the investigation conducted by the lokayukta.[3][59]

Removal

According to the Article 311 of the constitution, the lokayukta or an up-lokayukta can be removed only if found guilty in the report of committee headed by the judge of either Supreme court or Chief justice of the High court. The report is then forwarded to the Governor and then presented before the state legislature with each house of the legislature votes for the removal by 2/3 majority.[60]
